INCOTERMS AND THE 2020 VERSION
Incoterms form the basis of international trade.
If we take the example of two companies established in two different countries, each with its own language, business practices and distinct cultures, and geographically far apart from one another, it is necessary for these companies to find a common language if they wish to do business together.
In order to avoid certain disputes during an international purchase or sales transaction, the International Chamber of Commerce (ICC) developed the Incoterms ® rules.
Although their use is not mandatory, it is strongly recommended in international transactions as these rules are recognized by international trade stakeholders worldwide.
These rules define three essential points in international transactions:
► the transfer of risks,
► the sharing of costs,
► the documentary obligations of the buyer and the seller.
The 1st version dates back to 1936, but since then, with the evolution of international transport and business practices, the ICC has made several amendments to the Incoterms rules. Thus, the 9th version of the Incoterms rules has been in force since January 1st, 2020.
It includes 11 Incoterms:
E Ex Works (EXW)
F Free Carrier (FCA)
Free Alongside Ship (FAS)
Free on Board (FOB)
C Cost and Freight (CFR)
Cost, Insurance and Freight (CIF)
Carriage Paid To (CPT)
Carriage and Insurance Paid To (CIP)
D Delivered at Place (DAP)
Delivered at Place Unloaded (DPU)
Delivered Duty Paid (DDP)
What are the main changes introduced by Incoterms 2020?
► Removal of the DAT Incoterm, replaced by DPU;
► Differentiation of insurance coverage levels in the case of CIF & CIP Incoterms;
► Possible adaptation of the FCA to obtain the maritime bill of lading with on-board notation;
► Revision of the order of the articles referring to the various obligations of the seller and the buyer;
► Advisory notes becoming explanatory notes in the ICC publication and forming an integral part of the Incoterms rules;
► Desire for wider dissemination of the Incoterms 2020 rules.
Please note that in the 2020 version, the ICC once again emphasizes the limited use of maritime Incoterms, which are suitable only for the maritime transport of bulk goods or conventional cargo. As soon as goods are containerized (the most common case for companies), even if transport is maritime, only multimodal Incoterms must be used !
